Welcome to RaftingX! These Terms of Service ("Terms", "ToS" or "Agreement") govern your use of the website https://raftingx.com (the "Site") and all related services provided by Greatwhite Continuum Pvt. Ltd. ("Company", "we", "us" or "our"), operating under the brand name "RaftingX".

By accessing or using our Site and Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or Services.

1. Acceptance of Terms

By accessing or using the RaftingX platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

• You must be at least 18 years old to use our services independently
• If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms
• We reserve the right to refuse service to anyone for any reason at any time
• Your continued use of the platform after any modifications to these Terms constitutes acceptance of the updated Terms

2. Description of Services

RaftingX provides an online platform for booking river rafting expeditions in Rishikesh, Uttarakhand, India. Our services include but are not limited to:

• Online booking and reservation system for rafting expeditions
• Real-time trip tracking and status updates
• Operator management and fair rotation system
• Platform-level safety standards above the regulatory minimum
• Digital payment processing via authorized payment gateways
• Customer support and trip coordination
• QR code-based check-in at GMVN-designated reporting points

3. Use of Website

Permitted Use

You may use our Site to:

• Browse available rafting expeditions and routes
• Create bookings and manage reservations
• Access your account and booking history
• Communicate with our support team

Prohibited Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable local, state, national, or international law
• Attempt to gain unauthorized access to our systems, servers, or databases
• Interfere with or disrupt the integrity or performance of the Site or its services
• Upload or transmit viruses, malware, or any other malicious code
• Scrape, crawl, or use automated tools to extract data from the Site without our prior written consent
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Use the Site to collect, compile, or harvest any Personal Information of other users

4. Intellectual Property Rights

Our Content

All content on the Site, including but not limited to text, graphics, logos, images, audio, video, software, and compilations thereof, is the property of Greatwhite Continuum Pvt. Ltd. or its licensors and is protected by Indian and international copyright, trademark, and other intellectual property laws.

User/Operator Content

By submitting any content (reviews, feedback, photos) to the Site, you grant us a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, and display such content in connection with our services.

You represent and warrant that you own or have the necessary rights to grant this license.

Trademarks

"RaftingX", the RaftingX logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Greatwhite Continuum Pvt. Ltd. You must not use such marks without our prior written permission. Any unauthorized use constitutes a violation of our trademark rights and may result in legal action.

5. Booking Terms and Conditions

Booking Process

• All bookings are subject to availability and confirmation
• Booking confirmation is sent via SMS, Email, and WhatsApp to the registered mobile number
• You must provide accurate personal details for all participants at the time of booking
• Participants must carry a valid government-issued photo ID on the day of the expedition

Age and Health Requirements

• Participants must be at least 14 years of age (minors must be accompanied by a guardian)
• All participants must be able to swim or must wear provided life jackets at all times during the expedition
• Participants with heart conditions, epilepsy, or other serious medical conditions should consult a physician before booking
• Pregnant women are advised not to participate in rafting expeditions

Cancellation and Rescheduling

• Cancellation policies vary by expedition type and are displayed at the time of booking
• RaftingX reserves the right to cancel or reschedule trips due to unsafe weather or river conditions
• In case of cancellation by RaftingX, a full refund or rescheduling option will be provided

6. Payment Terms

General

All prices are listed in Indian Rupees (INR) and include applicable taxes unless stated otherwise. Payment is processed securely through Razorpay, our authorized payment gateway.

Payment Methods

We accept payments via UPI, credit/debit cards, net banking, and other methods supported by Razorpay. Cash payments may be accepted for walk-in bookings at authorized operator locations.

Refunds

Refunds, if applicable, will be processed within 7-10 business days to the original payment method. For detailed refund terms, please refer to our Refund Policy.

7. Safety and Liability

Safety Standards

All operators on the RaftingX platform hold valid Uttarakhand Tourism rafting permits. RaftingX enforces additional platform-level safety standards above the regulatory minimum, including mandatory pre-trip briefings, Certified whitewater life jackets (ISI-marked or international equivalent), certified guides, and real-time GPS tracking.

Assumption of Risk

White water rafting is an inherently risky adventure sport. By booking through RaftingX, you acknowledge and accept the risks associated with river rafting, including but not limited to physical injury, drowning, or property damage.

Participant Responsibilities

• Follow all safety instructions given by the assigned river guide
• Wear the provided life jacket and helmet at all times during the expedition
• Report to the designated GMVN reporting point on time with your booking QR code
• Do not consume alcohol or intoxicating substances before or during the expedition
• Inform the guide of any medical conditions or inability to swim

8. Warranties and Disclaimers

Limited Warranty

RaftingX warrants that the platform will function substantially in accordance with our published service descriptions.

Disclaimer

EXCEPT AS EXPRESSLY PROVIDED HEREIN, RAFTINGX PROVIDES ITS SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

The Company does not guarantee any specific outcomes, including but not limited to water level conditions, rapid intensity, or trip duration, which may vary based on natural river conditions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Liability Cap: RaftingX's aggregate liability arising out of or in connection with these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the claim
• Exclusions: In no event shall RaftingX be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill
• Force Majeure: RaftingX shall not be liable for any failure or delay in performance resulting from acts of nature, government action, natural disasters, floods, or other events beyond our reasonable control

10. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the course of using our services.

• Definition: Confidential information includes but is not limited to business plans, pricing structures, customer data, and technical information
• Exceptions: Confidentiality obligations do not apply to information that is publicly available, independently developed, or required to be disclosed by law
• Duration: Confidentiality obligations survive the termination of these Terms for a period of 2 years

11. Indemnification

You agree to indemnify, defend, and hold harmless RaftingX, Greatwhite Continuum Pvt. Ltd., its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Site or Services
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content you submit or provide through the Site
• Your negligent or wrongful conduct during any rafting expedition booked through our platform

12. Term and Termination

Termination by User

You may stop using our services at any time. If you have an account, you may request deletion by contacting us at info@raftingx.com.

Termination by RaftingX

We reserve the right to suspend or terminate your access to the Site and Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Effect of Termination

Upon termination, your right to use the Site and Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to:

• Natural disasters (floods, earthquakes, landslides)
• Adverse weather conditions or dangerous river levels
• Government actions, orders, or regulations
• Pandemics, epidemics, or public health emergencies
• War, terrorism, civil unrest, or strikes
• Power outages, internet failures, or telecommunications breakdowns

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site.

• Notification: We will endeavour to notify registered users of material changes via SMS or email
• Acceptance: Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms
• Disagreement: If you do not agree with any changes, you must discontinue use of the Site and Services

15. General Provisions

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Dehradun, Uttarakhand.

Dispute Resolution

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through:

1. Mediation: conducted by a mutually agreed upon mediator
2. Arbitration: if mediation fails, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996
3. Litigation: as a last resort, either party may pursue resolution through the courts of Dehradun, Uttarakhand

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the Site, constitute the entire agreement between you and RaftingX regarding the use of our services.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Waiver

The failure of RaftingX to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. RaftingX may freely assign these Terms without restriction.
